1. About the agreement

Visasvi is a service from Enertek Mateus Sybilla, org. no. 935 960 185, Lier. These terms apply to all jobs and to the Drift subscription.

The agreement consists of the quote and these terms. If the quote says otherwise, the quote applies. The agreement is made when the customer accepts the quote in writing, for example by email.

The service is sold to businesses only. Norwegian consumer law, including the right of withdrawal (angrerett), does not apply.

2. What's included

The job covers what is in the quote and in the package the customer has chosen.

I write the text for the pages in the package based on our conversation. The customer approves it.

After the first version, two rounds of corrections are included. A round is one combined list of changes. Each extra round is NOK 500 excl. VAT.

New pages, features or languages not in the quote are extras with their own price.

3. The customer's responsibilities

The customer provides a logo, photos and information about the business and answers questions within a reasonable time.

The customer has the right to use the material they provide and is responsible for it not infringing anyone else's rights.

If the job is on hold for more than 60 days because the customer doesn't deliver or reply, I may close it and invoice the work done. The deposit is not refunded.

4. Price and payment

The price is fixed and stated in the quote. All prices exclude VAT (MVA).

Half is invoiced at the start, and work begins when that invoice is paid. The rest is invoiced when the customer has approved the site, and the site is published once it is paid.

Payment terms are 14 days. Late payment interest follows the Norwegian Late Payment Interest Act (forsinkelsesrenteloven).

5. Preview and rights

Until the full amount is paid, the site is only shown on a private preview link. It is hidden from search engines and must not be copied, published or used in any other way.

Once the full amount is paid, the customer gets full rights to use the site, the text and the design, and receives the files on request. Fonts and other third-party components follow their own licences.

I may show the site as an example of my work unless the customer objects.

6. Drift

Drift covers hosting, SSL, the contact form, domain renewal and one small change a month of up to 15 minutes. Unused changes don't carry over to the next month.

Drift is invoiced in advance for one year at a time. The first year is invoiced together with the rest of the price for the site. It renews automatically for one year unless the customer cancels before the renewal date. Paid periods are not refunded.

When Drift ends, the customer receives the site's files and help moving the domain. If Drift is unpaid 14 days after a reminder, the site may be taken offline until it is paid.

Price changes are announced at least 30 days before they take effect.

7. Domain

New domains are registered in the customer's name, and the customer owns the domain. If the customer already has a domain, it stays with their current registrar.

8. Defects and liability

Defects in my work reported within 30 days of publishing are fixed free of charge.

The site is hosted by Cloudflare. I can't guarantee it is always available, but I fix problems as quickly as I can.

I am not liable for indirect losses such as lost revenue. My liability is limited to what the customer has paid for the job, and for Drift to what the customer has paid in the last 12 months.

9. Changes to the terms

A job is governed by the version attached to the quote. Changes affecting Drift are announced at least 30 days in advance.

10. Governing law and disputes

The agreement is governed by Norwegian law. Disagreements are first resolved by talking. If that fails, the case is decided by the district court (tingrett) where Enertek has its business address.
